Introduction
HANK Technology (HANK, we, us, our) respects your privacy and handles personal information in accordance with the New Zealand Privacy Act 2020.
This privacy statement explains how we collect, use, disclose, store and protect personal information in connection with this website, the HANK platform and related services, and our general business activities. Personal information is information about an identifiable individual.
This statement applies unless different or additional privacy terms apply under an agreement with a HANK customer. Where we process personal information in the HANK platform on behalf of a customer, we generally do so to provide, secure, maintain and support the services that customer has asked us to provide.
What personal information we collect
We may collect personal information that you provide to us directly, including your name, work email address, role, organisation, the content of your enquiry, and other information you choose to provide when you contact or work with us.
We may also collect information created through our business relationship with you, such as correspondence, meeting notes, contact history, and information relevant to a project, service or potential engagement.
Where a customer uses the HANK platform, we may process personal information that the customer or its authorised users provide, create or make available through the service. The types of information will depend on how that customer configures and uses HANK and may include work contact details, roles, approvals, work activity records and other information entered into operational workflows.
Where it is lawful and relevant to our business, we may collect business contact information from publicly available sources or from third parties, for example a company website, LinkedIn, a referral, or another business contact. Where the Privacy Act requires us to notify you about an indirect collection, we will take reasonable steps to do so as soon as reasonably practicable unless an exception applies.
When you use our website or services, we and service providers acting on our behalf may automatically collect technical information needed to operate, secure, understand and improve them. Depending on the technologies in use, this may include your IP address, browser or device information, pages or features used, referring pages, timestamps, server logs, performance or security events, approximate location derived from your IP address, and cookie or similar identifiers where used.
Why we use personal information
We use personal information to respond to enquiries and communicate with you; understand your organisation's needs and potential use cases for HANK; provide, support, develop and improve our products and services; understand how our website and services are used and measure their performance; manage customer, supplier, partner and other business relationships; protect the security and integrity of our systems and business; comply with legal obligations; and protect or enforce our legal rights and interests.
We may also use your contact details to send information about HANK where you have asked us to do so or where otherwise permitted by law. You can ask us to stop those communications at any time.
Where providing information is voluntary, you do not have to provide it. However, if you choose not to provide information we reasonably need, we may not be able to respond to your enquiry or provide the relevant service or information.
Who we may share personal information with
We may share personal information with service providers that support our website, hosting, analytics, performance monitoring, security, communications, IT systems, cloud services, software development, technical support and business operations; professional advisers such as lawyers, accountants or insurers; a regulator, law enforcement agency or other person where disclosure is required or permitted by law; a person involved in a genuine sale, merger, financing, restructuring or acquisition of all or part of our business; or another person where you have authorised the disclosure.
Where a service provider stores or processes personal information on our behalf, we take reasonable steps to ensure the information is appropriately protected and that the provider uses it only as necessary to provide its services to HANK.
We do not sell or rent personal information.
Overseas providers and disclosures
Some service providers we use may store or process information outside New Zealand. Where an overseas provider stores or processes personal information on our behalf, we remain responsible for taking reasonable steps to protect that information. Where we disclose personal information to an overseas person or organisation for its own purposes, we will comply with the cross-border disclosure requirements of the Privacy Act.
How we protect and retain personal information
We take reasonable steps to protect personal information against loss, unauthorised access, use, modification, disclosure and other misuse. No internet or electronic system can be guaranteed to be completely secure, so we also limit the personal information we collect to what is reasonably necessary for our purposes.
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, or as required for legitimate business or legal purposes. When it is no longer required, we will take reasonable steps to delete it, anonymise it, or otherwise securely dispose of it.
If a privacy breach is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act.
Accessing and correcting your personal information
Subject to the Privacy Act, you may ask us to confirm whether we hold personal information about you, request access to that information, or ask us to correct it if you believe it is wrong.
We may need to verify your identity before responding to an access or correction request. If we do not make a requested correction, you may ask us to attach a statement of correction to the information.
